Terms of sale
The terms that apply when you order flanges from Shiv Shakti Machine Tools, unless we agree otherwise in writing.
These terms
These terms apply to every quotation we give and every order we accept. If your order carries its own terms, ours apply unless we agree in writing to change them.
Quotations
A quotation is valid for the period it states. It covers the flanges, standard, grade, sizes, quantities, documents and delivery terms it lists, and nothing else.
Orders
An order becomes a contract when we confirm it in writing. Please check our confirmation: it records the standard, rating, facing, material grade, sizes, quantities, documents and delivery terms we will supply to.
Prices and payment
The currency, the delivery terms and the payment terms are those stated in the quotation and confirmed in the order.
Delivery
Delivery is on the Incoterms rule agreed in the quotation and confirmed in the order. Lead times are our best estimate when we confirm the order, and we keep you informed of any change. Flanges are packed for the journey, with a packing list for each case.
Specification
Flanges are made to the standard, rating and material grade in the confirmed order, with dimensions and tolerances as that standard sets out. The dimension tables on this website are for reference: confirm against your specification before ordering. Choosing the right flange for your service is your responsibility.
Documents and inspection
Each order is supplied with the documents listed in our confirmation, such as an EN 10204 3.1 material test certificate and a dimensional inspection report. Your inspector, or an agency of your choice, is welcome to inspect before dispatch by arrangement; the quotation says who pays for it.
Checking delivery and claims
Please check the flanges and documents when they arrive and tell us in writing of any shortage, damage or non-conformity within [CONFIRM: number of days], quoting the heat number and our order reference. Where flanges do not conform to the confirmed order, we will repair, replace or refund them. [CONFIRM: remedy offered, and any time limit after delivery]
Liability
[CONFIRM: limit of liability, and exclusion of indirect or consequential loss, as advised by your lawyer]
Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, strikes, transport disruption or government action. We will tell you promptly and agree the next steps with you.
Import and compliance
Import duties, taxes and licences in the destination country are the buyer’s responsibility unless the Incoterms rule in the order says otherwise.
Law and disputes
[CONFIRM: governing law and the courts or arbitration that settle disputes]
